Power of Attorney Services in Dubai for Individuals and Businesses

At Instant PRO, we handle every type of Power of Attorney — for residents and non-residents alike — in person or remotely for those who need an online Power of Attorney in the UAE from wherever they are, around the clock when the situation demands it. A POA in many circumstances cannot wait until the next business day.

From daily practice we know that most rejected Powers of Attorney are turned back not because of a notary error, but because of a mischaracterisation at the drafting stage: a POA drafted too broadly for the Notary Public to certify, a principal who lacks the authority to grant it, or a scope that does not match what the receiving authority actually requires. Our starting point on every file is therefore to establish the correct type of POA before drafting a single clause.

Send us your requirement via WhatsApp and we will confirm the right type, the required documents, and the full cost — within minutes.

What Is a Power of Attorney and What Types Exist

Article 866 of Federal Decree-Law No. 25 of 2025 Promulgating the Civil Transactions Law defines a Power of Attorney as a contract between a principal and an agent, by which the agent undertakes to perform a legal act in the principal’s name and on the principal’s behalf. This Law came into force on 1 June 2026, expressly repealing Federal Law No. 5 of 1985 which it replaced in its entirety.

Civil law jurisprudence — including the analysis set out by Al-Sanhouri in Al-Waseet — establishes a distinction that cannot be overlooked: a General Power of Attorney, which confers on the agent only acts of administration such as preserving and ordinarily managing assets; and a Special Power of Attorney, which is valid only for the specific acts that the principal has expressly and unambiguously defined — such as sale, mortgage, acknowledgement of debt, settlement, oath, and assignment of rights.

Dubai’s Notary Public works within this distinction and will not certify a POA that purports to grant “all powers over all matters”. Only a POA with a defined purpose and defined authority, drawn from the types recognised by the notary, will be accepted. Our first task on every file is to identify the real purpose of the POA before a single clause is written — because a POA with authority narrower than what the receiving authority actually requires will be rejected even after the notary has certified it, whether the destination is Dubai Land Department, Roads and Transport Authority (RTA), or a bank.

Power of Attorney Types We Handle — For Individuals

Real Estate Sale or Purchase POA

Among the most frequently requested, because a property transaction is a disposal in the strict legal sense. It requires the property to be clearly identified and the agent’s authority to be expressly defined: the power to agree a price, receive payment, and sign before Dubai Land Department. A sale POA and a purchase POA are drafted separately, because the authorities granted differ materially between the two directions.

Vehicle POA

Many people driving vehicles not registered in their name discover at a land border crossing that leaving the country with the vehicle requires a POA from the registered owner. This cannot wait. We make this type available electronically around the clock, so the owner can sign from their location and the certified document reaches the driver before they are forced to delay their journey.

Litigation and Disputes POA

This type authorises the named person to attend hearings and conduct proceedings on the principal’s behalf, whether civil or commercial. It requires a special POA that identifies the nature of the matter and the powers granted to the agent. It is not necessary in every case to name a specific claim or quote a case number, provided the nature of the work is adequately defined. Powers that go beyond representation at hearings — such as settlement, assignment of rights, or formal acknowledgements — must be expressly stated.

General Administration POA

For anyone who needs to delegate routine administrative tasks without conferring disposal powers — following up on a tenancy transaction, collecting a document, or appearing before a government authority. Its scope is limited to administrative acts; anyone who needs to go beyond this must move to a special POA with expressly defined authority.

Extended Special POA — Multiple Consolidated Authorities

In some situations a principal needs to delegate several matters at once without reaching the level of a sale or mortgage. In these cases we draft a carefully structured special POA that itemises each authority individually in terms the Notary Public will accept, without the broad generalisation that leads to rejection.

Power of Attorney Types We Handle — For Companies

Licensing and Company Formation POA

Required when a partner or founder authorises someone to carry out the licensing process before the relevant Department of Economic Development (DED) or free zone authority. We review the identity and authority of the person granting the POA before drafting — this document underpins every subsequent company document, and if it is signed by someone who does not actually hold formation authority, the entire transaction becomes complex.

Company Management POA

Authorises a person named by the partners or board of directors to act on the company’s behalf in its day-to-day affairs. Its scope is defined by the resolution that issued it and cannot be read beyond its stated limits.

Banking POA

Authorises a person to open the company’s bank account, operate it, or sign banking transactions on its behalf. This is among the most technically demanding POAs to draft, because banks typically require specific wording they will not waive. We therefore request each bank’s approved template before drafting and do not rely on a generic formulation.

Trademark and Intellectual Property POA

Used to authorise a local agent or specialist firm to register the company’s trademark or manage its proceedings before the relevant intellectual property authority. The trademark and the registration class must be specifically identified — a vague formulation is not accepted.

For all corporate Powers of Attorney we review the Memorandum of Association and trade licence before drafting, to confirm that the person signing as principal actually holds the authority to grant what is being delegated — because a person’s name appearing in the trade licence does not, by itself, confer authority to issue a banking POA or sell a share.

Power of Attorney Fees

The government fee for notarising a Power of Attorney — whether general or special — is set under Executive Council Resolution No. 4 of 2014 concerning Notary Public fees in Dubai, with the fee schedules as updated by Executive Council Resolution No. 72 of 2025, at AED 100 per signature per party, plus an AED 20 Knowledge and Innovation Fee per transaction.

POA TypeGovernment Fee
Notarisation of POA (general or special)100 AED per signature per party
Knowledge and Innovation Fee20 AED per transaction

The total government fee for a POA with a single principal is therefore AED 120. The complete cost will be confirmed to you in advance with a full breakdown.

Note: The fees above are government fees only. Private Notary Public fees are governed separately by Decision No. 312 of 2025 on the determination of Private Notary Public fees in the Emirate of Dubai, and vary depending on the service and method of completion. Applicable fees may include, depending on the case: AED 100 for registering each party’s details electronically, AED 100 per signature on the POA, and AED 1,000 for attendance outside the Private Notary Public’s office. Our service fees, along with any certified legal translation or consular attestation required by the circumstances, are also additional. We provide a written breakdown of every cost component before we begin, so there are no surprises.

How the Process Works

Step 1 — Tell Us What You Need

Send us the purpose of the POA via WhatsApp — even if you do not know its name or type. A brief description of what you want to delegate is enough.

Step 2 — We Classify the POA

We identify the right type — general or special — define the specific authorities it must carry and the authority it will be presented to, and prepare a document list with the full cost.

Step 3 — Verification and Drafting

We verify the principal's capacity and authority to grant the POA, cross-check names across all documents, and draft the POA on the approved form for your review before signing.

Step 4 — Submission

The application is submitted through the Dubai Courts Smart Notary system for those with a valid Emirates ID, or an appointment is booked with a Private Notary Public for those appearing in person with a passport.

Step 5 — Identity Verification and Signing

Identity is verified and the POA is signed electronically via UAE Pass remotely, or in person before the Private Notary Public.

Step 6 — Receiving the POA

You receive the certified POA as soon as it is approved — electronically or in hard copy — along with guidance on any further requirements of the authority it will be presented to.

Documents Required for a Power of Attorney

The Notary Public verifies three things: the principal’s identity, their status, and their authority. Required documents follow from this.

For individuals: A valid Emirates ID is required for anyone completing the transaction electronically and remotely; a passport alone is sufficient for those appearing in person. You will also need a statement of the POA’s purpose with the relevant specifics — the property number and location for a real estate POA, the vehicle plate number and details for a vehicle POA, the case reference for a litigation POA, or the name of the receiving authority for a banking or administrative POA.

For companies: A valid trade licence, the Memorandum of Association with all its latest amendments, the Emirates ID and passport of every signatory, and documentation showing that the signatory holds authority to grant the POA under the Memorandum of Association or a resolution of the partners.

A name discrepancy between the Emirates ID, the passport, and the trade licence — even a single character — is one of the most common reasons a Power of Attorney is rejected. We cross-check all names before drafting, not after.

Online Power of Attorney in the UAE

The Dubai Courts Smart Notary system enables individuals — and certain corporate transactions — to complete an Online Power of Attorney UAE remotely, provided every signatory holds a valid Emirates ID through which identity verification and electronic signing are carried out. Those with only a passport — such as a visitor or an investor based abroad — must appear in person before a Private Notary Public; this can be arranged on the day of their arrival or through our Business Bay office.

If you are currently outside the UAE, do not travel before consulting us — many situations can be resolved through UAE Pass or through a locally authorised representative. The service is available around the clock, seven days a week including public holidays, because situations such as a vehicle POA needed at a border crossing cannot wait for the next working day.

Power of Attorney Issued Outside the UAE

Anyone outside the UAE who needs to grant a Power of Attorney for use within it has two options: appear before a Private Notary Public in person on the day of arrival with their passport, or have the POA notarised in their home country and then complete the required attestation chain.

The attestation chain for a foreign-issued document requires: authentication by the competent authority in the country of issue, then attestation by the UAE diplomatic mission in that country, then attestation by the UAE Ministry of Foreign Affairs (MOFA), and finally a certified legal translation into Arabic. The sequence is essential — a document must be attested before it is translated, not after. The UAE is not a party to the Hague Apostille Convention, which means an apostille does not replace consular attestation for documents intended to be relied upon before UAE authorities.

This route typically adds one to two weeks depending on the country of issue. We advise on this timeline before the process begins so there are no surprises.

Common Reasons a Power of Attorney Is Rejected

From our experience, Powers of Attorney are returned or rejected for the same reasons repeatedly — all of which can be identified before submission:

  • Drafted too broadly for the Notary Public to certify, or too narrowly for the authority that will receive it.
  • Signed by someone who lacks authority to grant the POA — such as a director whose authority the Memorandum of Association restricts.
  • The agent’s stated authority is narrower than what Dubai Land Department or the bank actually requires.
  • An expired Emirates ID used in a remote transaction.
  • A name mismatch between the Emirates ID, the passport, and the trade licence — even a single character.
  • A foreign document submitted without attestation, or with the attestation steps performed in the wrong order.
  • A translation that is not certified, or was obtained before the attestation process was completed.
  • An amendment to the Memorandum of Association overlooked, causing a conflict between partner details and the trade licence.
